Terms of Service

    Please read these Terms of Service ("Terms") carefully before using Gallerify ("Service"), operated by Gallerify ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

    1. Acceptance of Terms

    By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

    2. Description of Service

    Gallerify is a platform that enables photographers to create, manage, and share photo galleries and portfolio pages with clients. The Service includes gallery hosting, portfolio pages, client-sharing tools, and related features as described on our website.

    3. Accounts

    Registration

    You must create an account to access most features of the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

    Security

    You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@gallerify.app if you suspect unauthorised access to your account.

    4. Subscriptions and Billing

    Free Trial

    New accounts receive a 14-day free trial with full access to the Service. No payment method is required to start a trial.

    Paid Plans

    After the trial period, continued use of paid features requires a subscription. All fees are billed in advance on a monthly or annual basis depending on your chosen billing cycle. Prices are displayed in USD and may vary by region.

    Cancellation

    You may cancel your subscription at any time from your billing portal. Your plan remains active until the end of the current billing period. We do not prorate cancellations.

    Refunds

    We offer a 7-day refund window from the date of your first charge. To request a refund, contact support@gallerify.app. Refunds outside this window are issued at our discretion.

    Price Changes

    We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price change. Continued use of the Service after the effective date of a price change constitutes your agreement to pay the updated price.

    5. User Content

    Your Content

    You retain full ownership of all photographs, images, text, and other materials you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free licence to store, display, and deliver your content solely for the purpose of operating and providing the Service to you and your clients.

    Content Standards

    You agree not to upload content that:

    • Infringes any third party's intellectual property or privacy rights
    • Is unlawful, defamatory, obscene, or otherwise objectionable
    • Contains malware, viruses, or other harmful code
    • Violates any applicable law or regulation

    Removal

    We reserve the right to remove any User Content that violates these Terms or that we reasonably believe creates legal exposure for us or others, without prior notice.

    6. Acceptable Use

    You agree not to:

    • Use the Service for any unlawful purpose
    • Attempt to gain unauthorised access to any part of the Service
    • Reverse engineer, decompile, or disassemble any part of the Service
    • Use automated tools to scrape, crawl, or harvest data from the Service
    • Resell or sublicence access to the Service without our prior written consent
    • Interfere with or disrupt the integrity or performance of the Service or its infrastructure

    7. Intellectual Property

    The Service, including its design, code, trademarks, and all content created by us, is owned by Gallerify and protected by applicable intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without our prior written consent.

    8. Data Retention

    If your account is cancelled or your subscription expires, your galleries and uploaded content may be retained for a grace period before permanent deletion. We will notify you before any permanent deletion occurs. You are responsible for exporting any content you wish to keep.

    9. Third-Party Services

    The Service integrates with third-party services including payment processors and cloud storage providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

    10. Disclaimers

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FULLY SECURE.

    11. Limitation of Liability

    TO THE FULLEST EXTENT PERMITTED BY LAW, GALLERIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

    12. Indemnification

    You agree to indemnify and hold harmless Gallerify and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

    13. Termination

    We may suspend or terminate your account at any time if you violate these Terms or if we reasonably believe your account poses a risk to the Service or other users. You may terminate your account at any time by contacting us or using the account deletion option in your settings.

    14. Changes to These Terms

    We may update these Terms from time to time. When we do, we will update the effective date above and, for material changes, notify you by email or a prominent notice within the Service. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

    15. Governing Law

    These Terms are governed by the laws of the jurisdiction in which Gallerify is incorporated, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction.
